The purpose of www.zontone.fr is to present the photographic work of Laurent Zontone and, where this functionality is available, to offer Fine Art photographic prints for purchase.
Users agree to use the website in accordance with applicable laws and regulations.

● the rights of persons depicted in photographs;
● the integrity or security of the website.
Photographs displayed on the website may not be copied, downloaded, reproduced, modified, distributed or otherwise exploited without prior authorization, subject to statutory exceptions.
Laurent Zontone makes reasonable efforts to ensure the accuracy of the information presented on the website but cannot guarantee that the website will be completely free from errors or continuously available.
These Terms of Use are governed by French law, subject to any mandatory provisions that may apply to consumers residing in another country.
5. TERMS AND CONDITIONS OF SALE — FINE ART PRINTS

2. Purpose
These Terms and Conditions govern the sale of Fine Art photographic prints offered on www.zontone.fr.
The photographs offered are original works by Laurent Zontone.
The essential characteristics of each print, including the photograph, format and characteristics of the medium, are specified on the website before the order is placed.
3. Standard Prints and Customized Orders
Certain prints are offered in predefined formats and specifications.
Customized works may also be offered by quotation when the customer requests a particular format, size or other specific characteristic.
Any customized order is subject to prior agreement between Laurent Zontone and the customer.
4. Prices
Prices are stated in euros.
Under the applicable French tax regime:
VAT not applicable — Article 293 B of the French General Tax Code.
Any applicable delivery charges are indicated during the ordering process and are added to the price of the print where applicable.
5. Ordering and Payment
Payment may be made:
● by credit or debit card through Stripe;
● through PayPal.
The available payment methods are indicated during the ordering process.
An order becomes final once it has been validated and payment has been confirmed.
6. Delivery
Prints may be delivered within France and internationally, depending on the destinations offered at the time of purchase.
Delivery charges are calculated and displayed during the ordering process.
In the event of visible damage to the parcel or print upon delivery, the customer is encouraged to contact Laurent Zontone as soon as possible and to retain any evidence of the issue, including the packaging and, where possible, photographs of the parcel.
7. Right of Withdrawal
For standard, non-customized prints sold remotely, consumers are generally entitled to the statutory right of withdrawal provided for under the French Consumer Code.
The statutory period is generally fourteen days from receipt of the goods.
However, under Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply, in particular, to goods made according to the consumer’s specifications or clearly personalized.
Where a print is specifically produced according to the customer’s specifications or is clearly personalized and the statutory exception applies, the right of withdrawal therefore does not apply.
This provision does not affect any statutory warranties or legal rights applicable to the consumer.
8. Statutory Guarantees
All statutory guarantees applicable to consumers remain fully applicable.
Nothing in these Terms and Conditions of Sale shall have the effect of removing or limiting any rights legally granted to consumers.
9. Ownership of the Print and Copyright
The purchase of a Fine Art print does not constitute an assignment of the copyright attached to the photograph.
Upon full payment, the purchaser becomes the owner of the physical print.
The purchaser does not, however, acquire any right to:
● reproduce the photograph;
● digitize the print for the purpose of distributing the image;
● reprint the photograph;
● publish the digital file;
● distribute or sell the image;
● exploit the photograph for commercial or advertising purposes;
● modify the photograph or incorporate it into another work.
Any use of the photograph beyond the purchaser’s private possession and enjoyment of the physical print requires the prior written authorization of Laurent Zontone.
The acquisition of the physical print and the acquisition of exploitation rights in the image are legally distinct transactions.
10. Complaints

Laurent Zontone will make reasonable efforts to seek an amicable solution to any difficulty arising from the performance of an order.
11. Consumer Mediation
Laurent Zontone has initiated the process of joining the Association des Médiateurs Indépendants d’Île-de-France (AMIDIF).
Membership is pending as of the date of this update.
The mediator’s contact details and the precise procedure for referring a dispute to the mediator will be incorporated into these Terms and Conditions of Sale once membership and the mediation agreement have been finalized.
Once membership has been finalized, the legally required information concerning the consumer mediator will also be made available on the website.
12. Applicable Law
These Terms and Conditions of Sale are governed by French law.
Where a consumer resides in another country, this provision does not prevent the application of mandatory consumer protection provisions applicable to that consumer under the relevant law.
COPYRIGHT AND LICENSING
All photographs presented on www.zontone.fr constitute photographic works by Laurent Zontone and are protected by copyright.
Viewing or displaying a photograph on the website does not grant or transfer any right of reproduction, representation, distribution, adaptation or exploitation.
Any use of a photograph that is not covered by a statutory exception requires the author’s prior written authorization.
Any licensing request should specify, depending on the nature of the project:
● the photograph concerned;
● the intended use;
● the media involved;
● the territory;
● the duration;
● the nature of the exploitation;
● and, where applicable, the financial terms.
Purchase of a Fine Art Print
The purchase of a Fine Art print does not grant any right to reproduce or distribute the photograph.
The purchaser becomes the owner of the physical print but acquires no copyright or exploitation rights in the underlying image.
The purchaser may therefore not:
● reproduce the photograph;
● digitize it for distribution;
● reprint it;
● publish it as a digital file;
● use it for commercial purposes;
● incorporate it into another creation;
● transfer to a third party rights that the purchaser does not own.
Any exploitation license must be subject to a separate written agreement with the author.

7. IMAGE RIGHTS
Some photographs presented on the website were taken in public places as part of Laurent Zontone’s artistic and documentary practice, particularly his street photography work.
The fact that a photograph is taken in a public place does not, by itself, mean that publication or exploitation of an identifiable person’s image is automatically free from legal restrictions.
The circumstances in which a photograph may be captured, published or exploited must be assessed according to the specific circumstances of each image, its purpose and the applicable rights.
Laurent Zontone is committed to carrying out his photographic work with respect for the dignity of the people he photographs.
Any person who believes that a photograph published on the website infringes their rights, or who wishes to obtain information concerning its use, may contact the author directly:
